Litigation, Arbitration and Mediation: Part IV

Mediation is a formal method by which the parties can try to settle the dispute before it is decided by a third party at a trial or an arbitration final hearing.  Whereas litigation and arbitration are generally mutually exclusive, meaning parties can choose litigation or arbitration, but not both, mediation is available in arbitration and litigation.
