Weekly D867a, Case NO. 3D12-3216, issued April 17, 2013: The probate division order denying motion to dismiss and compel arbitration based on similar pending actions between the parties, was reversed and remanded based on an Operation Agreement containing an arbitration provision where there was no evidence of a waiver of that provision.
